Community under Article 227(4) of the
Rome Treaty unless other arrangements are
negotiated. If Gibraltar is to maintain
her free port arrangements we shall ·
probably have to negotiate for her specific
includion within the scope of the
Community's directive on this subject; and
bring her arrangements into conformity with
the provisions of this directive, details
of which are attached at Annex IV.
40. It should be noted that, if Gibraltar
becomes part of the Community under Article
227(4), and if Spain successfully concludes
the preferential trade agreement which it
has now negotiated with the Community,
Spain will be bound by the provisions of
that agreement in so far as trade between
Gibraltar and Spain is concerned. The
present members of the Community may be
reluctant to become embroiled in this
particular political problem, but it would
be in our interests to achieve for
Gibraltar the inclusion in the Community
which would be her legal right.
Conclusions
Our negotiating objectives for the
Commonwealth can be summarised as follows:
(a) special arrangements for New Zealand's
dairy producers and developing
Commonwealth sugar producers. These
are dealt with elsewhere;
(b) reactivating where still appropriate
the provisional agreements reached in
1962 in so far as they relate to
Commonwealth countries in Asia,
