WHEREAS such provisions show certain inequalities which, should they exist after the completion of the customs union, could cause deflection of trade and customs receipts;
WHEREAS such provisions directly affect the setting up and operation of the common market;
WHEREAS the consumption of goods, their use, handling and treatment must be effected under the same economic conditions throughout the entire territory of the Community;
HAS ADOPTED THIS DIRECTIVE: -
Article 1
(1) This Directive lays down the rules which provisions imposed by law, regulation and administrative action in Member States must include relating to the free zones scheme.
(2) Free zones shall mean, whatever expression is used in Member States, any territorial enclave set up by the competent authorities of Member States, hereinafter called the "competent authorities", for the purpose of deeming goods therein not to be in Community customs territory for the application of customs duties, agricultural levies, itative restrictions and all taxes or measures having equivalent
quan effect.
(3) This Directive applies to:-
(a) The territorial enclaves referred to in the Annex hereto; and
(b) the territorial enclaves referred to in paragraph 2 which
may be set up after its application.
Article 2
(1) Subject to the provisions of paragraphs 2 and 3, goods of every kind shall be admitted into the free zone, whatever their quantity, country of origin, source or intended use,
(2) The provisions of paragraph I shall not preclude:-
(a) The imposition of a prohibition or restriction justified by
reason of public morality, public policy ("order public"), public safety, protection of the health and life of humans and animals or preservation of plant life, protection of national treasures of artistic, historical or archaeological value, or the protection of industrial and commercial property;
(b) the righ of the competent authorities to restrict access to certain free zones or parts of free zones for specific goods on technical or administrative grounds.
