matter in respect of which the Attorney General certifies that its di

closure in any such report

(a) might prejudice the security, defence, or international rela-

tions of the Government of the United Kingdom or the Government

of Hong Kong (including the relations of either Government with

the Government of any other country or with any international

organization); or

(b) right prejudice the investigation or detection of any offences;

or

Cases to which section 22

applies.

(c) might involve the disclosure, without the consent of the

Governor, of the deliberations of the Executive Council.

21. (1) The provisions of section 22 shall apply in any case in

which, after making an investigation, the Commissioner is of opinion

that the decision which was the subject matter of the investigation

(a)

appears to have been contrary to law; or

(b) was unreasonable, unjust, oppressive or improperly discrimina-

tory, or was in accordance with a rule of law or a provision

of any law or a practice that is or may be unreasonable, unjust,

oppressive or improperly discriminatory; or

(c)

was based wholly or partly on a mistake of law or fact.

(2) The provisions of section 22 shall also apply in any case where

the Commissioner is of opinion that in the taking of the decision a dis-

cretionary power has been exercised for an improper purpose or on

irrelevant considerations, or that, in the case of a decision made in

the exercise of any discretionary power, reasons should have been given

for the decision.
