We do not know whether your Legal
Draftsman, when preparing the draft Bill,
had access to any precedents other than
those of the United Kingdom and New Zealand,
but you may be interested to see the enclosed
copies of the following documents: -
(a) Those sections of the Guyana
Independence Order, 1966, which
relate to the establishment,
powers and functions of a post
of Ombudsman;
(b) The annual report of the Guyana
Ombudsman for 1967 (the first
full year of his operations);
(c) the relevant extract from the
report of the Fiji Constitutional
Conference of 1970;
(a) those sections of the draft
Fiji Independence Order, 1970,
which relate to the establishment
powers and functions of a post
of Ombudsman.
The above documents are not, of course,
particularly appropriate precedents for Hong
Kong since they relate to independent (or
shortly to be independent) territories;
but they may give you some ideas and afford
you some general guidance in the final
framing of your Bill. I should perhaps
mention that in the case of Fiji we
consider here that the duties to be put
upon the Ombudsman have been overloaded
- certainly before his capacity has been
tested in practice.
