In his personal and confidential letter to you
of 3 August, the Secretary of State mentioned, inter
alia, that we would be consulting the Parliamentary
Commissioner here in connection with the proposal
Commericoner for.
Administration
Post of
to establish a hilar office in Hong Kong and that
we would thereafter let you have our considered views
on the matter. I am accordingly writing to you in
fulfillment
t of that undertaking.
We have, of course, had the benefit of seeing
the draft Commissioner for Administration Bill which
was prepared in Hong Kong some time ago; and although
that Bill was intended to be no more than a working
document, we assume that it does in some measure
reflect your ideas of how any decision to establish
a post of Parliamentary Commissioner or Ombudsman
should be implemented.
We note that the draft Bill follows the New
Zealand model in certain important respects
notably in that it does not link the Commissioner
with members of the Legislature in the way that is
done in this country. Conditions in Hong Kong are
not, of course, the same as they are here; a
requirement that complaints must be routed through
unofficial members of the Legislative Council would
undoubtedly do much to enhance the status of such
members, but in the particular circumstances of
