Hong Kong (Non-Domiciled Parties) Divorce Rules
I am sorry that you have had to remind us for a reply to your letter of 18th November, 1968; as Mr. Bridgeman's secretary has explained, the matter is no longer his responsibility and, since I have been holding the fort pending the arrival of his successor, I have been rather overwhelmed.
I have, however, referred your letter to Parliamentary Counsel and I attach an extract from Mr. Fiennes' reply. You will no doubt wish to let your lawyers have a look at his opinion.
If it is decided to proceed by Transfer of Functions Order we in the Civil Service Department will need to make a submission for the Prime Minister's approval since changes in the machinery of Government, and although there is not at present a Secretary of State for the Colonies this must count as such a change, are the Prime Minister's prerogative. All we need is a brief statement describing the powers which need to be transferred and the reasons for making the transfer. I expect you will be producing something on these lines for your own Minister and it would be very helpful if you could let me have a copy of your submission.
