The advice given to your Department by Mr. Fiennes was put by our Legal Adviser to the Lord Chancellor's Office; enclosed are copies of his letters. Also enclosed is a copy of Bourne's reply, from which you will see that we can dismiss the idea of a Transfer of Functions Order. I am sorry that this has turned out to be a red herring, and I am very grateful for your help in this matter.
