I am minuting to you in the absence of
Sir James McPetrie.

Lord Parker, the Chief Justice, will be in Hong Kong from 1 4 February. He will be staying with Sir Michael Hogan, the Chief Justice Hong Kong. As
Mr. Murray's indicated in the minute below, he stands ready
(at Lord Shepherd's suggestion) to take up with
Sir Michael the question of appointing members of the Hong Kong bar to the Bench there. I was told on
24 January that, in suggesting to the Lord Chief Justice that he might raise this in Hong Kong, Lord Shepherd had no more in mind than an exploratory informal
exchange of views with Sir Michael Hogan.

You will see from the letter at (9) on HWB 14/61 attached, Hong Kong's reply at (1) on these papers and Sir James McPetrie's minute of 22 January that
this is a matter of some delicacy. There can be no question, I think, of Lord Parker being given any form of official brief to pursue this matter. But in
view of Sir James McPetrie's comment that he feels
Hong Kong have not thought this question properly through in consultation with the Chief Justice, there
would seem to be some advantage in informal exchanges between Lord Parker and Sir Michael Hogan and the
former may well be able to make a useful contribution
to further examination of the question in Hong Kong.
4. The Lord Chief Justice's Secretary has asked for a "brief" (Mr. Murray's minute of 22 January below). I suggest we might offer a "Background Note" on the lines of the attached draft. If you agree, it would perhaps be more appropriate if you rather than
this department sent it.
