DUMPING DUTY : AUSTRIA

We are enclosing a communication we have received from one of our Austrian customers, Messrs. Moden Landa of Linz. As you will see, they state that they received from us thirty-six mon's pullovers, as per Invoice: 36568 of which we also enclose a copy. It appears that the Austrian authorities have informed them that wool pullovers, cardi- gans or sets below a minimum price of Austrian Sch.324 (approximately, £5 4s. 3d) per kilogramme attract an anti-dumping duty and they have surcharged them with Austrian Sch.675 (approximately, £10 15s. Od), in respect of this consignment. A copy of the account from the Austrian Customs is also attached.

In our opinion this anti-dumping duty is not justified and contravenes the anti-dumping regulation of GATT. In support of this statement, we would mention the following:

The pullovers in question are identical with those produced for our own stores in this country and are, therefore, regular merchan- dize at a regular price.

The strict quality control to which our goods are submitted results in the fact that ours are by no means the cheapest lines of their type available.

In order to cover our export operation we up- lift the prices quoted by our factories which means that our export customers buy at a
