after there should be a flat rate for assigned cases as follows:-

Capital cases: Fee $500 with $300 daily refreshers

Other Cases Fee $300 with $200 daily refreshers

The Committee regards these proposed fees as very reasonable in view of the time that would have to be devoted by counsel to assigned criminal and civil cases in any given year, and to the fact that acceptance of assigned cases would result in most barristers having to refuse other more remunerative forms of work."

CONTROL OF REMUNERATION OF BARRISTERS IN

PRIVATE PRACTICE

I note that the statement that "The Bar Committee con- siders it incongruous that the remuneration of barristers in private practice should be controlled by the Chief Justice", was intended to refer only to remuneration in legal aid cases. It may perhaps be remarked that in England the power to fix fees in such case is vested in the Home Secretary.
