SUPREME COURT RULES COMMITTEE
A Sub-Committee was formed by this Committee to draft the Supreme Court Rules, 1967, and Cheung, Q.C. was a member of the Sub-Committee. The new Rules of the Supreme Court, 1967, came into effect on the 2nd Sep- tember 1967. These rules replaced the Code of Civil Procedure. The purpose was to bring practice into line with England, except where certain of the English Rules were inapplicable. However, portions of the Code of Civil Proce- dure have been retained, and are distinguished by the letter "A" suffix.
SUMMARY COURT COMMITTEE
(1) The Working Party on Traffic Summary Offences. A report has been made and sent to the Governor. The general purpose of the recommendations is that simple charges should be removed from the criminal courts and should create a civil liability. A copy of the report is being obtained
(2) Police Prosecutions and methods of laying informa- tions. A Magistrate has prepared a paper in which the question whether a police officer who is a named informant should be present at the hearing is con- sidered and authorities on the need for named inform- ants to appear are cited. His conclusion, which coin- cides with the general opinion referred to in the 1966 Annual Report, p.20, is that neither the police officer nor the Attorney General need appear in person. This paper does not attempt to lay down a binding interpre tation of the law. The Association has a copy of the repore which may be made available to members.
