The recommendations of the Committee are not binding on
the Colonial Secretary or on the Governor. It is the Governor
who is responsible to the Secretary of State for the security
of the Colony and the final decision must be his.
Review Procedure
5. A detained person can lodge objections against his
detention to the Committee of Review immediately after the
order is made, and thereafter at intervals of not less than
two months. Each case is carefully examined by the law
officers before a detention order is made. The reasons for
detention are given to the detainee. At the discretion of the
Committee of Review, the detainee can present his objections
through counsel, solicitor or other agent.

The case for continued detention is regularly reviewed by
the Hong Kong authorities with a view to release as soon as
possible, having regard to the security considerations
involved.

7. There are now six persons remaining in detention in Hong Kong under the Emergency (Principal) Regulations.
Continued Retention of Powers of Detention
8. The power of detention under Regulation 31 of the Emergency (Principal) Regulations will not be retained for
longer than the security situation requires.
