Functions of Committee of Review

1. The recommendations of the Committee of Review are not

but it is the Governor who is responsible

lightly disregarded;

for the maintenance of security in Hong Kong, and the final

decision must be his.

2. The functions of the Committee of Review are to consider

and make recommendations to the Colonial Secretary, Hong Kong,

with regard to any objections against any detention order made

under Regulation 31 of the Emergency (Principal) Regulations,

which are duly made to the Committee by the person to whom the

order relates.

Review Procedure

A detained person can lodge objections against his

detention to a Committee of Review immediately after the

detention order is made, and thereafter at intervals of not less

than two months.

4. Each case is carefully examined by the Law Officers before

a detention order is made.

The reasons for detention are given

to the detainee. At the discretion of the Committee of Review,

the detainee can present his objections through counsel,

solicitor, or other agent.
