he was present in Hong Kong, on a ship or on an aircraft registered in long
Kong, or in relation to rights or obligations which accrued or arose in
Hong Kong or on or in such ship or aircraft.
(4) Where a complainant has been removed from Hong Kong under the
(Cap. 239.) Deportation (British Subjects) Ordinance, the Deportation of Aliens Ordi- (Cap. 240.)
nance or the Immigration (Control and Offences) Crdinance, he shall, if the (Cap. 243.)
Commissioner so directs, be permitted to re-enter and remain in Hong Kong,
subject to such conditions as the Governor may direct, for the purposes of
the investigation.

16. (1) Before investigating any decision, the Commissioner shall

(2) Every investigation shall be conducted in private. Counsel and
solicitors shall not have any right of audience before the Commissioner.
(3) Subject to the provisions of this Ordinance, the Commissioner may
hear or obtain information from such persons, and make such inquiries, as he
thinks fit. It shall not be necessary for the Commissioner to hold any
hearing, and no person shall, subject to the provisions of subsection (4),
be entitled as of right to be heard by the Commissioner.
(4) If at any time during the course of an investigation it appears to
the Commissioner that there may be sufficient grounds for his making any
report or recommendation that may criticize or adversely affect any officer,
department or person he shall give to the officer, head of department
affected or person an opportunity to be heard.
(5) Subject to the provisions of this Ordinance, the Commissioner may
regulate his procedure in such manner as he thinks fit.
17. (1) Subject to the provisions of this section and sections 18
and 19, the Commissioner may require any person who, in his opinion, is
able to give any information relating to any decision which is being
