4. The Commissioner shall not, without the approval of the Governer

office as Commissioner, or angago in any occupation for reward outside tho

(c) is suspended or removed from office;
(a) is absent from Hong Kong; or
(e) is for any other reason unable to perform the functions of his
office,
those functions shall be assumed and performed by such person as may be
appointed to act as Commissioner by the Governor, by writing under his hand,
until such time as the Commissioner resumes the functions of his office or
a new Commissioner is appointed under section 3.

(2) A person may be appointed to act as Commissioner under subsection
(1) notwithstanding that he does not comply with the provisions of section 4.
6. (1) The Commissioner shall hold office on such terms and conditions
