(e) a law by reason of which the grievance arose or may arise

should be reconsidered; or

(f) reasons should be given for the use of a discretionary power;

or

(g) other steps should be taken as he may advise; then the Ombudsman shall report his adjudgment with his reasons there- for to the authority concerned with such recommendations as he may think fit and, where he so recommends, he may request the authority concerned to notify him, within a time limited, what the authority proposes to do thereon.

(2) Where the authority, after the lapse of a period deemed reasonable by the Ombudsman, does not act upon the Ombudsman's recommendations, refuses to act thereon, or acts in a manner un- satisfactory to the Ombudsman, he may send a copy of his report and recommendations, with any comment he may wish to add thereto, to the Governor, and may thereafter make such report to the Legis- lative Council as he thinks fit.

Optional Rejection of Jurisdiction

The Ombudsman should have the option, at his complete dis- cretion, not to take any action on a complaint even though it is techni- cally within his jurisdiction. In any case where the Ombudsman decides not to investigate or further investigate a complaint, he shall inform the complainant of his decision and may, if he thinks fit, state his reasons therefor.

Investigatory Procedures

The Ombudsman should have access to all documents, including all relevant files, with the one exception that if top secret documents are required he should be shown them only with the consent of the Governor. Any Government servant should be compelled to supply any information requested by the Ombudsman with the one above mentioned exception and the Ombudsman should have a right of entry into any Government office exerciseable by himself or his authorised assistants.
