PART VII.

Employment Agencies.

26. No person shall, in the Colony, under 'ake any operation with the object of procuring, obtaining or supply. te labour of pe sons for employment within the Colony or under

erseas

contrats who do not spontaneously offer their services ither to

a pros ective employer direct or at an employment agency registered

with tle Commissioner.

27. Nothing in this Part shall be construed to prohibit the advertisement, in the press or by means of posters, notices, letters or word of mouth, of vacancies for employment.

28.

The Commissioner may make regulations for all or any

of the following matters -

(a) prescribing the manner in which employment agencies

shall be registered with the Commissioner;

(b) prescribing the conditions under which such registration

ray be refused or cancelled;

(c) prescribing the nature of the services in respect of

which employment agencies may charge fees and expenses;

(d) fixing the amounts of any such fees and expenses; (e) providing for the exemption, subject to such conditions

as may be prescribed, of all or any classes of employ- ment agencies from the provisions of this Part;

(f) prescribing the records to be kept and returns to be made to the Commissioner by employment agencies.

29. (1) In this Part

V

"employment agency" moans any person who acts as an intermediary

for the purpose of procuring or obtaining employment for another person or supplying the labour of another person for an employer with a view to deriving either directly or indirectly any pecuniary or other material advantage from either the employer or any such other person; but does not include newspapers or other publications unless they are published wholly or mainly for the purposes of acting as intermediarios between employers and prospective employees;

"overscas contract" has the meaning assigned to it in the

Contracts for Overseas Employment Ordinance.

(2) Section 3 shall not apply to this Part.
