28. DANGEROUS PRACTICES AND DEFECTS. Where a registrable workplace is operating without a certificate of registration or is in breach of any condition laid down in the certificate of registration, upon the conviction of the proprietor of the offence in question, a Factory Inspector may apply to a magistrate for permission to seal or otherwise lock such plant or machinery as the inspector may think necessary to prevent the plant or machinery from being used. It is an offence to remove or break any such seals or locks while the plant or machinery remains in the registrable work- place.

9. Upon complaint by a Factory Inspector a magistrate may, if he is satisfied that any machinery cannot be used or process carried on without risk of bodily injury:-

(i) prohibit the use of any plant or machinery either entirely or until

such time as it may be rendered safe for operation

(ii) require the proprietor to take such steps as may be specified to

remedy the danger

(iii) order that the machinery be sealed or locked in such a manner as the inspector may think necessary to prevent the machinery from being used.

30. NOTIFICATION OF ACCIDENTS AND DANGEROUS OCCURRENCES. Accidents causing loss of life must be reported within 24 hours of the death of the person concerned to a Factory Inspector and to the nearest police station. Any accident preventing a worker for 24 hours or more from performing his ordinary work must be reported within 48 hours of its occurrence to a Factory Inspector. The report may be made orally by telephone or in person or in writing and must state the name of any person injured, the extent of the injury, and the circumstances in which the accident occurred. If the accident occurs in circumstances giving rise to a claim for compensation under the Workmen's Compensation Ordinance, a report must be made on form 2 (LD 27).

31. Certain dangerous occurrences must be reported in writing to a Factory Inspector whether or not disablement is caused. These include the bursting of a revolving vessel, wheel, or grindstone moved by mechanical power, the collapse or failure of a crane, hoist, or other lifting appliance or of any part of such appliance (except the breakage of chain or rope slings), the overturning of a crane, explosions or fires in certain circumstances, and the collapse in whole or part of any roof, wall, structure, or foundation forming part of the premises of an industrial undertaking in which persons are employed.
