APPLICATION
1. INDUSTRIAL UNDERTAKINGS AND REGISTRABLE WORK. PLACES. Some statutory requirements of the Factories and Industrial Undertakings Ordinance No. 34 of 1955 and of the regulations made under it apply to all industrial undertakings. Other statutory requirements apply only to those industrial undertakings which are required under Subsection (1) of Section 7 of the Ordinance to be registered or provisionally registered at the office of the Commissioner of Labour. The types of industrial under- taking hich have to be registered are referred to in this Guide as registrable workplaces and consist of:-
(i) any factory
note: Concerns in which less than 20 workers are employed or in which there is no power driven machinery are not required to be registered unless there are special hazards involved in the processes used or the concern is carried on in aid of a registrable workplace operated by the same proprietor
(ii) any mine or quarry
(iii) any place in which a dangerous trade or process is carried on.
2. Full registration is granted if the Commissioner is satisfied that the registrable workplace is suitably located and the undertaking can be carried on in accordance with the provisions of the Ordinance and Regulations. Provisional registration is granted in cases where, although its location is not entirely satisfactory, the undertaking can be carried on with due regard to the safety, health and welfare of persons employed therein and of the public. A certificate of full registration is valid for up to two years at a time whereas a certificate of provisional registration is valid for a period of not more than twelve months.
3. It is an offence to operate a registrable workplace which has not been registered or provisionally registered. Any person who is in doubt as to his obligations should seek advice from any office of the Labour Department before commencing to operate a workplace.
4. The provisions in this Guide which apply solely to registrable work- places are marked with an asterisk.
5. The provisions outlined in paragraphs 11, 13, 14, 15, 16, 17, 18, 19, 21, 23, 25, 31, 32, 33 and 39 apply to building and engineering construction sites, whether or not registration under Section 7 of the Ordinance is required. In addition, such sites must have adequate means of escape in case of fire and adequate fire-fighting appliances. Smoking and use of naked lights may be prohibited on such sites if inflammable liquids or materials are used.
