6. Lord Tangley asks if the Minister would be willing to receive oral representations from a delegation from Rediffusion Limited. The company have not ceased to acquaint us fully, at the official level, with the issues involved and with their interests in the matter. I do not really see any point in the Ministers agreeing to receive a delegation from them. The whole question will be submitted for Ministerial consideration when the time comes for a decision to be taken. It will then be for consideration whether it might be politic for the Minister to see representatives of Rediffusion Limited to explain the reasons for the decision. I attach a draft reply to (75) for consideration.

I agree that we are not yet in a position to tell Lord Tangley that Section 40(3) will be applied to Hong Kong; the Governor may wish to present objections, though I gathered from Mr. Hobley (an assistant Hong Kong law officer) that there would probably be no objection to the application of that subsection. 2. Rediffusion did ask a little while ago, I understood from the Private Office, whether their legal advisers could discuss the matter with the Commonwealth Office legal advisers. I have heard nothing further on this and perhaps it would be inappropriate for me to see them now that there is an appeal before the Privy Council in connection with which the Commonwealth Office legal advisers are concerned to pass on to lawyers acting on behalf of the Government of Hong Kong the instructions of that

Government.
