Any question of Sergeant Chu's reinstatement must be
ruled out on the grounds of his age alone. In addition, he
could not be reinstated so long as the verdicts of guilt, which
led to his dismissal, continued to stand. These verdicts
could be reversed only by special legislation.

The making of an ex gratia payment to him, whether by way
of a lump sum or pension, would not in itself require any
special legislation.

But it would raise a number of serious
(a) an ex gratia payment would not clear Sergeant Chu's
name; however, it might well be regarded by him, by
the Press and by others (since it could not avoid
publicity) as an admission of doubt on the part of
the Government about his guilt;
(b) it would then be extremely difficult to resist pressure (Parliamentary or otherwise) for full
clearance of his name;
(c)
the reputation of the Hong Kong Police Force, and the
Special Branch in particular, would be exposed to a
major threat if favourable treatment were now accorded
to Sergeant Chu who is still regarded by the Police
Force as a traitor;
