APPENDIX NO. 1

WARRANT OF APPOINTMENT

COMMISSIONERS POWERS ORDINANCE (Chapter 86)

APPOINTMENT of CommissioNERS

IN exercise of the powers conferred upon him by section 2 of the Commissioners Powers Ordinance, the Governor-in-Council has appointed the persons specified in the Schedule as Commissioners for the purpose of instituting, making and conducting an inquiry in accordance with the terms of reference set out in paragraph 5 and of reporting to the Governor thereon.

2. Any two of the Commissioners shall form a quorum for the purpose of discharging any of the functions (other than that of reporting) of the Commissioners.

The Governor-in-Council deems it expedient and directs that all the Commissioners shall have all the rights, powers and privileges specified in section 3 of the Commissioners Powers Ordinance.

4. The Governor-in-Council directs that the Commissioners shall conduct the examina- tion of witnesses in public, save that-

(a) the Commissioners may conduct the examination of any witness in private if in the opinion of the Commissioners it is in the public interest expedient so to do. (b) nothing in this paragraph shall oblige the Commissioners to take oral evidence from a witness if, in their opinion, documentary evidence by such witnesses is sufficient.

The terms of reference of the said inquiry shall be as follows-- 'To inquire into and report on-

(a) the disturbances in Kowloon between the 5th and 8th April, 1966, inclusive; (b) the events leading up to such disturbances; and

(c) the causes thereof.'

6. The Governor-in-Council has appointed Mr. Steuart Alfred WEBB-JOHNSON, J.P., as Secretary to the Commissioners.
