with perpetual succession and a com- mon seal..
(3) The Board shall consist of the following members:
(a) two architects holding office in the Government of Hong Kong provided they are qualified in accordance with Section 6(1)
(a) of this ordinance, appointed by His Excellency the Governor of Hong Kong. (b) the professor of Architecture,
University of Hong Kong; and (c) four practising architects of at least three years standing in the Colony of Hong Kong, at least two of them shall be qualified in accordance with Section 6(1) (a) of this Ordinance, appointed by the Governor in Council. Special powers of the Board
4. Without prejudice to the powers possessed by virtue of its incorporation, the Board shall have the power
(a) to hold or arrange for the bolding of such examinations as the Board may deem necessary for the purpose of enabling persons to qualify for registra tion under this Ordinance;
(b) to fix, from time to time, subject to the approval of the Legislative Council, the scale of fees to be charged by persons registered under this Ordinance for professional advice or services rendered or work done;
(c) to hear and determine disputes between persons registered under this Ordinance;
(d) to appoint arbitrators for the purpose of hearing and determining disputes between persons registered under this Ordinance and other persons or firms; and
(e) to fix and regulate the etiquette of the architectural profession in the Colony.
Power of Board to cancel registration (9). (1) If any person who has been duly registered under this Ordinance shall:
of any
heinous
(a) be convicted
offence; or (b) be guilty of any act or conduct
(which, in the opinion of the Board, is infamous in any pro- fessional respect, whether such an act or conduct arises from the breach of the provisions of this Ordinance or of any rule made thereunder or otherwise; or (e) fails to renew his certificate of registration on ог before the 31st day of January in any year; the Board may, after due enquiry, order the cancellation of the certificate of registration and the striking off from the register of the name of any such person.
(2) If any person registered under this Ordinance receives any com- mission which, in the opinion of the Board, is an illicit commission, or acts
29 a contractor, or deals in building materials, such person shall be deemed to be guilty of an act infamous in a professional respect within the meaning of paragraph (b) of subsection (1) of this section.
Saving of existing rights
21. Nothing in this Ordinance contained shall be construed so as to prohibit or prevent any person from performing any function which prior to the coming into force of this Or- dinance he might lawfully have per formed in the particular sphere of operations applicable to his profession. Qualifications for registration
6. (b) Any person who, on the of application for registration under this Ordinance, is registered as an Authorised Architect under the Building Ordinance of 1935, and who, on the commencement of this Ordinance, is practising the profession of architect in the Colony.
B (1) The Clerk of Councils shall publish annually by notification in the Gazette a list of all such architects engineers and other persons as the Governor in Council may deem qualified to perform the duties required by this Ordinance to be performed by an authorised architect. Such list shall include the names of the Director of Public Works and of such other officers of the Public Works Department as the Goveruor in Council may think fit. The Clerk of Councils shall from time to time similarly publish the names of persons added to or removed from the last published annual list by Order of the Governor in Council, The last published list as so amended shall be deemed the current authorised list.
(2) The Governor in Council shall not order the insertion of the name of any person in any such list unless he deems him in all respects fit and suit- able to be authorised.
(3) The Governor in Council may by order remove the name of any autho- rised architect who has ceased to practise in the Colony, he may also, on any ground which he may deem sufficient, remove the name of any person he may consider unfit or GEI- suitable to continue to be authorised: but in such last mentioned case notice shall be given, if practicable, to the person whose name it is proposed to remove and he heard by the

6. (+) On the completion of any repairs, alterations от additions to any existing building the authorised architect who supervised such repairs, alterations or additions shall furnish his certificate to the Building Authori ty stating that the same have been completed in accordance with the ap- proved plans. Such certificate shall

be in the form contained in Schedule D. Failure to furnish the Building Authority with such certificate within one week after the date of completion of work shown on the approved plan shall render the authorised architect liable upon summary conviction to a fine not exceeding ten dollars per day in respect of each day of his default.
(5) Adequate supervision in and throughout the carrying on of works shown on any plans approved by the Building Authority shall be exercised by the authorised architect who has signed such plans. Provided that if at any time prior to the completion of such works the supervision thereof be transferred or changed to another authorised architect the latter shall exercise adequate supervision of such work and shall also if required by the Building Authority furnish fresh plans for his approval.
Notice in writing of any such trans- fer or change of supervision shall be given to the Building Authority im- mediately after the date of such transfer or change by both the autho rised architect whose duty it was to supervise the work up to date of such transfer or change and also by the authorised architect to whom the supervision has been transferred ог changed. Failure on the part of au authorised architect to furnish such notice to the Building Authority within two days after the date of such transfer or change shall render such architect liable upon summary convie- tion to a fine not exceeding ten dollars per day in respect of each day of his default,
Failure on the part of ar authorised architect to exercise adequate super- vision in and throughout the carrying on of any work which it is his duty to supervise shall render him liable upon summary conviction to a fine not ex- ceeding two thousand dollars.
(6) (a) Every misrepresentation of a material fact in any plan, certificate or notice submitted or furnished to the Building Authority shall be deemed a contravention of this Ordinance and the person who has signed any such plan, eertificate or notice shall be liable upon summary conviction to a fine not exceeding two thousand dollars,
(b) Every material divergence ΟΙ deviation from the work shown in any plan approved by the Building Autho rity, unless such divergence or devia- tion has received the written approval of the Building Authority shall be deemed 1 contravention of this
Ordinance. In respect of any suel divergence or deviation which is not so approved, every owner, agent, archi- tect, engineer or clerk of works who condones such divergence or deviation
