to the Superintendent of the Gaol, and in default of such payment, the gaoler may such seaman: Provided that every seaman imprisonel under this chapter may be sent on board his ship prior to her departure from th waters of the Clony by directi on of the committing magistrate.
XXI. In the event of the death of any of the passengers, or other persons, occurring on board of any merchant vessel in the waters of the Colony, or on voyage to the Colony, or in case of te death, desertion, or removal of any of the crew, the master of such vessel shall fo thwith report the same to the Harb ur Master, under a penalty not exceeding twenty-five dollars for every death, desertion, or remova! which he shall neglect to report.
XXII. Any seaman, or other person, who shall give a false description of his services, or show, make, or procure to be male, any false character, or shall make false statements as to the name of the last ship in which he served, or as to any other information which may b required of him by any person having lawful authority to demand such information, sball incur a penalty not exceeding fifty dollars.

REGULATIONS.
Duties of Master.
XXIV. Every master of a merchant ship shall hoist her national colours and number on entering the waters of the Colony; and shall keep such number flying until the ship shall have been reported at the Harbour Master's Office.
2. Harbour Master and Health Officer to be allowed on board at once.
3. Every such master shall, with twenty-four hours after arrival within the waters of this Colony, report the arrival of his ship at the Harbour Master's Office, and in the case of a British ship, or of a ship which shall not be represented by a Consul, shall deposit there the ship's articles, list of passengers, ship's register, and true copy of manifest if required. In the case of a foreign ship represented by a Consul, the said papers shall be lodged by the mister at the proper consulate. Any master offending against the provisions of this sub-section shall incur a penalty not exceeding two hundred dollars.
4. Subject to the provisions of section 30 every such master arriving in the water of the Colony shall tak up the berth pointed out by the Harbour Master, or by any person sent on Loard by him for that purpose, and shall moor his ship there properly, and shall not remove from it to take up any other berth, without his permission, except in case of necessity, to be decided by the Harbour Master, under ap. nalty not excelig one hundred dollars; and he shall remove his vessel to any new berth when require l so to do by the Harbour Master, under a fine not excee ling twenty dollars for every hour that the vessel shall remain in her old berth after notice to remove under the hand of the Harbour Master, or his deputy, shall have been given on board of her.
5. Every such master shall immediately strike spars, clear hawse, or shift berth, or obey any other order which the Harbour Master may think fit to give, and any master wilfully disobeying or neglecting this regulation shall incur a penalty not exceeding two hundred dollars.
6. Every such master about to proceed to sea shall where practicable hoist a blue peter twenty-four hours before time of intended departure, and shall give notice thereof to the Harbour Master, who, if there is no reasonable objection, will furnish a port clearance, and attest the manifest if necessary; and any master having obtained such clearance an not sailing within thirty-six hours thereafter shall report to the Harbour Master his reason for not sailing, and shall redeposit the ship's papers if required. Any master wilfully neglecting or disobeying this regulation, or going to sea without having obtained a port clearance, shall incur a penalty not exceeding fifty dollars.
