Memorandum in terms of your telegram was presented by Counsellor August 12th, before my return, to Acting Minister for Foreign Affairs, Chiang Kai-shek having excused himself from receiving former on grounds of pressure of other work. Counsellor was sent for by Acting Minister for Foreign Affairs tonight and handed over reply which starts by quoting Embassy memorandum and continues:

"The Chinese Government regret to find that what is proposed in foregoing memorandum in regard to British desire to reoccupy Hong Kong and to ensure control over Headquarters of Japanese Southern armies, etc., is not in accord with general order of surrender which President Truman has sent to Supreme Commander for Allied Powers and of which this Government has received a copy. It is stated in paragraph "A" of above-mentioned order that "The Senior Japanese Commanders and all ground, sea, and air auxiliary forces within China (excluding Manchuria), Formosa and French Indo-China north of 16 degrees north latitude shall surrender to Generalissimo Chiang Kai-shek".

"The Senior Japanese Commanders and all ground, sea, air and auxiliary forces within Andamans, Nicobars, Burma, Siam, French Indo-China south of 16 degrees north latitude, Malaya, Borneo, Netherlands Indies, New Guinea, Bismarcks and Solomons shall surrender (to Supreme Allied Commander, SEAC or Commanding General Australian forces the exact break between Mountbatten and Australians to be arranged between them and details of this meaning then prepared by Supreme Commander for Allied Powers)."
