With reference to Foreign office letter No. F215/98/10 of the 24th January, I am directed by Lord Moyne to transmit to you, to be laid before Mr Secretary Eden the enclosed copy of a despatch from the Officer Administering the Government of Hong Kong, forwarding for the signification of His Majesty's pleasure the Immigration Control Ordinance, 1940. Copies are also enclosed for convenience of reference of certain Hong Kong Ordinances to which reference is made in the report by the Attorney-General which forms the second enclosure in Lieutenant-General Norton's despatch. It would be appreciated if these enclosures were returned to this Department in due course.

Subject to Mr. Eden's views, Lord Moyne proposes to inform the Acting Governor that in present circumstances at Hong Kong the power of non-disallowance will not be exercised in respect of this Ordinance. He proposes however at the same time to remark expressedly upon the emergency purpose of this legislation and on the intention to re-examine the whole problem as soon as circumstances permit. In this connexion he proposes to draw particular attention to the objection to which section 12 (2) of the ordinance (which would allow the Immigration officer to refuse admission to British subjects born and normally resident in Hong Kong,) is exposed as a provision of normal law.
