where the Second Police Magistrate decided to hear the case

against Chiu Yan Sau, remanding the first defendant pending

hearing of this case. The charges against Yan Tong and

Luk Chung Ping were withdrawn. The documents in the case

were examined by the Postmaster General and the case against

Chiu Yan Sau proceeded with on 19th April, 1939. Acting

in accordance with instructions received from the Postmaster

General I formally withdrew the charge of maintaining,

working or using the radio set and substituted a charge of

carrying messages intended for transmission by telegraph

under section 16 of the Telecomunication Ordinance. The

Second Police Magistrate heard he evidence but decided that

guilty knowledge had not been proved and accordingly dis-

charged the defendant.

On the 21st inst. I proceeded to Tai Po Police

Court where Mr. Barrow, heard the case against the first

defendant. He having pleaded guilty was fined $50 for

working the set, and the transmitter and all gear were

confiscated. Case No.628/39.
