(b) be disregarded for the purposes of the limitations im- posed by subsection (3) of this section on the size of the transport unit.

(6) In performing their duties under this section the Com- mission shall consult the Board and act on lines settled from 51 time to time with the approval of the Board, and no invitation to tender for a transport unit shall be issued by the Commission without the approval of the Board and no tender for any trans- port unit shall be accepted by the Commission without the approval of the Board; and the Board shall not give their 10 - approval to the acceptance of any such tender unless they are satisfied that the price is a reasonable one having regard to the value to the purchaser of the property and rights which he will obtain by the purchase, including the rights provided for by Part I of the First Schedule to this Act:

Provided that if any difference arises between the Commission and the Board as to the lines on which the Commission are to act in performing their duties under this section, either the Commission or the Board may refer the matter to the Minister and the Minister shall give such directions therein as he thinks fit, and any directions so given by him shall be binding on the Commission and the Board.

(7) In this section "specified" means specified in the public notice inviting the tenders or ascertainable in the manner speci- fied in that notice.

4. (1) The Commission may, within six months from the passing of this Act or such longer period as the Minister may allow, cause to be incorporated under the Companies Act, 1948, one or more companies which shall be under their control and the powers of which shall include power to carry on business as 30 carriers of goods by road in Great Britain.

(2) Where either-

(a) an invitation to tender for the purchase of specified property has been issued under the last preceding section; or

(b) the Board have approved the issue by the Commission

of such an invitation; or

(c) the Board haye informed the Commission that they would be prepared to approve the issue of such an invitation,

the Commission may, if the Minister gives his consent, make over to any company incorporated under subsection (1) of this section all the property and connected rights and obligations, if any, which the purchaser would have obtained under a purchase
