had signed the genuine lease, and they would be able to prove that these men were not living in 1801. The forger had furthermore made the bargain money the same, $31. He seemed to have broadly copied the genuine lease, alter- ing of course the essential feature of the period. The Ng family were the ultimate owners of this whole district; the only question was the period of the Wong's lease.

His Lordship With reference to the sigua- tares to this lease, do father and son not sometimes have the same names?

Mr. Sharp said that might be so, but the appellant bad the family register to show that there was only one man of that name in each of the families in question. His Lordship-What was the date of that deed ?

Mr. Sharp said it was dated 1879 and was the copy of one of an earlier date which bad become rotten with age.

His Lordship did not see why if there was such a lease, which expired in 1896, the Ngs did not go into possession at the end of the lease. Why were the Wongs allowed to retain possession until the land became very valuable by the taking over of the New Territories?

Mr. Sharp pointed out that the Wongs continued in possession and paid rent.

His Lordship-Your case is, that this deed is a forgery?

Mr. Sharp-Yes.

His Lordship granted the application. He said he thought that the Land Court ought to be allowed to state a special case, With regard to the question of costs, this being the first case of the kind: there was a special tribunal appoint- ed by the Government for the settlement of these claims, and parties did not reed to pay anything to have that done; if they were not satisfied with the decision of that tri- bunal and came to the Supreme Court, the Court must make some proviso as to costs, otherwise the man who had plenty of money and made a lot of claims would come there and some poor man who could not afford to fight it out would have no chance at all. Therefore, be thought there should be a sum of money deposited for costs. Otherwise, for the man with money it would be "Heads I win, tails you lose."

Mr. Sharp said he thought that the respond ents would be the Wongs only. The appellant's case was that. they had perpetrated a fraud upou the Land Court, and in the circumstances he thought the appellant should not be compelled to find security.

His Lordship said that was a case of having had a grand law suit for nothing. A man who had nothing at all might come to the Supreme Court and appeal and make out a plausible case-his Lordship was not suggesting that it was so in this case and then if he got judgment given against him, might go calmly away and say he had no money.

Mr. Sharp contended that to compel the appellant to lodge a deposit, was improperly embarrassing him under the dircumstances, if he was right in his statement that the Woogs had perpetrated a fraud upon the Land Court.

His Lordship-I may say I do not see where the appellant got his status as head of the family. Mr. Sharp-He undoubtedly is the senior elder of the family.

His Lordship He will probably put the price of this land into his own pocket, when he gets it.

Mr. Sharp-I believe he has no personal interest in the case, because the property! belongs to the junior members of the family.
