April 19, 1902.]

His Lordship - I think it would be much bet- ter if you would answer the question. The fact that he offered some resistance does not neces- sarily mean that there was a violent struggle.

Witness-Yes, th re was a struggle. Mr. Slade-Was there a violent struggle? There was certainly a struggle.

Was it a violent struggle?—I had some diffi onlty in getting him down.

Was it a violent struggle or was it not P-I don't know that you have a right to talk to me in that tone.

Will you please answer my question, Captain Pillsbury?

The witness again appealed to his Lordship, who said that he was certainly being addressed in rather a loud tone, but that that objection would doubtless disappear if he would answer the questions.

Witness-There was a violent s ruggle. Mr. Slade-You might have answered the question five minutes ago.

Captain Pillsbury denied most emphatically that it was he who tried to get into the stewardess's cabin, and was prevented by the prisoner.

Mr. Slade I put it to you that you

had addressed your attentio as to the stewardess several times during the course of that voyage

-That is not true.

to

That Marshall, the prisoner, had remonstra- ted with you for so doing ?-That is not true.

That at or near. Yokohama he came up you as man to man, and not as steward to cap- tain, and that he told you exactly what he thought about yon for carrying on with that. woman-That is not true,

Did he not say that he would rather pay the stewardess's fare back by another steamer than see you behaving in the way you were? -No.

The cross-examination of the witness con- cluded shortly afterwards, and James MoDer- mott, the watchman on the Peru, gave evidence similar to that at the Police Court, which also has already been published.

The case was subsequently adjourned until ten o'clock this morning.
