Although most consumer transactions are on a cash basis, many traders allow the goods to be supplied on credit. Trade credit means that payment has to be made some time after the goods are despatched. It is commonly used the term hire. purchase to describe this type of credit. Under this term, the buyer's are allowed to pay for the goods in instalments. This expression covers three main types of hire purchase arrangements::
a. Conditional Sale Agreement

Hire Purchase Agreement
under this agreement, the buyer is the hirer since the goods have hired to users. The hirer is not under an obligation to buy the goods.
The ownership of the goods has passed to the buyer when he exercises the option to purchase the goods by the end. of the hire period:
The goods remains the legal property of the seller until the last payment has been made by the hirerin
Within the hire period, the hirer has no right to resale the goods to another person because the hirer is not the true owner.
c. Credit Sale Agreement
Under this agreement, the goods become the property of. the buyer when he pays the deposit or the first instalment. The buyer undertakes to pay the total -purchase price by a stated number of instalments. It is not commonly used for expensive durable goods because the seller has no guarantee that the buyer must pay his instalments. It is commonly employed where the buyer is known to the soller.
If the buyer defaults repayments, the seller cannot. repossess the goods, but the seller can sue for repayment from the buyer.
Advantages and Disadvantages of Hire Purchase

3. Legal Aspects in a Hire Purchase Transaction
The Consumer Credit Ordinance is designed to provide certain
guidelines which are used to protect the interests of both
parties: the seller and the hirer.

Under a hire purchase agreement, the hirer, has entitled: to terminate the agreement at any time when half of the total hire purchase price has been paid and the goods should be returned to the seller.

If the agreed instalments are overdue, a reminder letter must be given to hirer before the seller can repossess the goods.
If one third or more of the total purchase price has been.. paid by the hirer, the seller can only repossess the goods with a court order

The Consumer council was set up in April, 1974. It is a statutory body of charging with the responsibility of protecting and promoting the interests of consumers in Hong Kong. Its functions are:

c. to encourage, business and professional associations to set up codes of practice in the hope of regulating the activities of their members;

of the Governor-in-Council,"

In order to assess the adequacy of the legislation, the existing consumer protection laws are being kept under constant review.
Several consumer protection laws have been passed by the government. They include:

It entitles the buyer with right to claim against seller.

This ordinance is to make provision with respect to standards and units of measurement and measuring or weighing "equipment used for trade, as well as to regulate trade transactions regarding goods or pre-packed goods supplied by weight or measure.
