In Hong Kong, the Judi- clary is one of the three branches in the government structure. It is complete- ly independent from the Legislative and the Execu- tive Branches. The head of the Judiciary is the Chief Justice. The Judiciary consists of the Full Court the (the Court of Appeal), Supreme Court, the District Courts and the Magistracy. It also includes the Coron- ers Court, the Tenancy Tri- bunal, the Labour Tribunal, the Lands Tribunal and the Small Claims Tribunal.
A. The independence of the Judiciary
The senior officials of the Judiciary are appointed by the Governor on the re- commendation of the Secre- tary of State. By the Let- tere Patent, a judge of the Supreme Court may be remov- ed only for inability to discharge the functions of his office or for mis-beha- viour. Decisions made by the courts of law cannot be interfered by the Governor, the executive and the legi- elature. It is essential that judges should be free

1. The Magistracy
a. Magistrates Courts are the lowest courts in

2. The District Courts
a. District Judges are Annointed by the Governor on the recommendation of the Chief Justice.
b. It tries civil diapu- tes in which the value of the subject matter is under
$20,000 or $15,000 in the case of a dispute over land
c. It tries criminal cases transferred to it by the Magistracy with the ma- ximum sentence of seven years' imprionment.
d. It hears appeals from the Tenancy Tribunal and Labour, Tribunal.
e. Legal aid is availab- le in the civl court.
f. It also hears appeals on stamn and rating..
3. The Supreme Court
a. It hears the most se- rious criminal cases by a single judge sitting with a jury of seven persons.
b. In civil jurisdiction it tries all cases in divo- rce, lunacy, probate, bank- ruptcy and company winding- up matters.
e. Except in capital ca.... ses, the verdict of a jury can be by a majority of five or more jurors.
