applied to Hong Kong?

Law is defined as rules of conduct imposed by a state upon its members and enforced by the courts, And the "Rule of Law” is used to mean a just and fair legal system under which anything done must be done in accordance with the law, Under the British system of Justice, the Rule of Law implies that

the fundamental human rights the citizens must be respected and protected, f.e. the right to life and

press, freedom of speech and

All disputes must be settled by law.

This principle of the Rule of Law: applies to the legal system in Hong Kong.

In the first place, in order to pro- tect and respect the rights of the city Izens from the encroachment of the Gover nor, the Judiciary is independent, I.. the Governor has no control over the Judiciary in H.K. He cannot change the decision of the Court, though he may pardon a criminal on death sentence..

Secondly, the Ch

Chief Justice and other puiane Judges are appointed by the Governor with the approval of the Queen. These judges are appointed for life. They cannot be removed unless with the approval of the Queen.

Thirdly, in order to show that everyone is equal before the Law, a sub- pect can plead on his own behalf, or employ a lawyer to defend himself in the Court. If he is too poor to employ one, he can apply for legal aids. The legal aid implies that nobody is denied the rights to defend himself,

Fourthly, all officials and unoffic- fals in H.K. are tried in the same court and by the same law. In France, civil servante are tried by Administrative Law. and non-civil servants by the Ordinary Law.

Fifthly, the police in H.K. cannot search and arrest any person, unless he 18 suspected and caught red-handed." And if he is caught he must be brought be fore the Court within 48 hours. If an Innocent person is detained without any cause, he can accuse the police for false Imprisonment,

Sixthly, a suspect cannot be punished until he is convicted in the Court. Before that, any suspect is presumed innocent and can be bailed out subject to the approval of the Court.

Seventhly, to show that all trials are fair and impartial, all serious crim- inal cases are tried by Jury in the Sup- reme Court. If the convicted are not satisfied with the decision of the Court, they have the right to appeal to the Full Court and the Privy Council in Britain.

Eighthly, a suspect must be proved beyond any reasonable doubt before he is convicted guilty.

Lastly, many courta are set up in H.K., such as the Tenancy Tribunal, etc to assist citizens to solve their disputes and no one should resort to force as a means to settle claims on another person.

Thus the Rule of Law applies to everyone irrespective of one's rank, race and creed.
