The Governor's legal powere

are such that if he chose to

exercise his full authority he

could turn himself into a dictator. In theory, he is constitutionally entitled to ignore the advice of. The Executive Council. He could override any opposition in the Legislative Council by directing. the official majority to repeal or pass any ordinances he wished; he could completely reverse past policies and set the whole Colony in turmod1.

However, the power of The Governor described above is not unlimited. Firstly, his power is bound by the Constitution. of Hong Kong which sets down rules under which he cannot act...

Secondly, he receives ins- tructions from the Secretary of State for Foreign and Commonwealth: Affairs directing him how Hong Kong should be ruled from time to time.

Thirdly, the Governor has to act on the advice of The Executive Council. If he acts independent of the Executive Council, he has to report. to the Secretary of: State for Foreign and Commonwealth' Affairs his reasons for acting 80. However, in case of emergency, e.g• a riot, até, the Governor can act without prior consulting the

·members of the Executive Council.

Fourthly, the Governor though. Commander-in-Chief of the British Army here, is entirely separated from the military force... The f British Force in Hong Kong is resy ponsible to the Ministry of Defence in Britain,

Fifthly, there are laws, like the marriage system of Hong Kong. the Consitution of Hong Kong, the currency and the discipline of

military staff.in Hong Kong are

beyond the power of the Legislative

Council. They cannot be passed by

the Governor in Hong Kong.

1) The Governor is the Queen's

Representative in Hong Kong. The Governor is acting on behalf of the Queen as.the. norminal Head of Hong Kong. The Governor is the chief administrator of the Governe ment of Hong Kong.

The Governor heads The Government machinery of Hong 'Kong and carries out the

day-to-day administrative routine.

3) The Governor is the Comman-

der-in-Chief of Hong Kong.

In emergencies, the Governor, as commander-in-chief, per- Bonally orders. troops to

assist in the maintenance of internal security in Hong Kong.

The Governor is entitled to appoint government officers, judges, Justice of Peace, as well as a Deputy Governor to execute his duties when he is on leave or sick.

5) The Governor is the Exm

officio member and presides the-Executive Council which is acting like his personal cabinet.

6) The Governor is the President: of the Legislative Council. All bills passed in the Legislative Council must be approved and signed by the Governor before they become Ordinances in Hong Kong.

7) The: Governor has the right to

grant-pardons to offendera. Being the Queen's' Cative and the Terry

Head of the Colony, the Governor, acting on the advice of the Executive Council, can pardon any ser- ious offenders sentenced for capital punishment.

Seventhly, the Judiciary in

the British Rule of Law is inden pendent of the Governor who can not: influence the decision of the Gourts.

to respect public opinion on all government policies. Without first consulting the Public, the government policies may not receive the co-operation and the support the people.
