CONFIRMATION OF THE MINUTES OF MEETING HELD ON 12 & 14 JANUARY 1999

The minutes of meeting held on 12 and 14 January 1999 were confirmed.

II. PAPER LAID

The following paper was laid - Report to the Provisional Urban Council by the Secretary, Provisional Urban Council, for the month of January 1999.

III. QUESTIONS

1. The Chairman on behalf of Ms. Jennifer CHOW Kit-bing asked the following question (in Cantonese): 'I have recently received street traders' complaints that the Hawker Control Team acted unreasonably against them. In this respect, I have the following questions:

(i) What criteria are adopted by the Department in stipulating the types of goods permitted for sale under dry goods and wet goods licence?

(ii) As far as I understand, both ginger and fruits have belonged to category two items permitted for sale under the dry goods licence. Why have amendments suddenly been made recently? What are the reasons?

(iii) If the types of goods permitted for sale under a licence are to be amended, what methods or procedures will be taken by the Department?'

MR. IP Kwok-chung, Chairman of the Markets and Street Traders Select Committee, replied as follows (in Cantonese): This is a three-part question concerning the commodities licensed hawkers are allowed to sell. I believe that the question arises from a recent incident in Wan Chai District where Hawker Control Team (HCT) staff took action against licensed fixed pitch hawkers trading at Tai Yuen Street / Cross Street for selling commodities which are not endorsed on their licences.

The first part of the question is about the criteria adopted by the Department in stipulating the types of goods endorsed on the 'dry goods' and 'wet goods' licenses. In respect of Fixed Pitch (Other Classes) Hawker Licences, the current Council policy is that the licences should be endorsed for
