MR. DANIEL TO BOON-MAN (in Cantonese):-I would like to ask the Chairman of the Select Committee for his opinion on fixed penalties. What is the reason behind the Department's claim that fixed penalties for litterbugs will have little deterrent effect. That is my first question.
The second question I would like to ask the Chairman of the Select Committee is whether the issue will be taken back to the Public Health Select Committee for discussion.
The third question covers what this Council will do about it if the functions and policies of the Healthy Living Steering Committee contradicts those of this Council. I would like answers on the above questions.
MR. JOSEPH CHAN YUEK-SUT (in Cantonese):-Mr. Chairman, it may not be appropriate for me to speak on fixed penalties in my capacity as Chairman of the Public Health Select Committee. I can certainly give my personal opinions at meetings of the Select Committee. However, if I am expected to speak the views of the Whole Council, I will have to wait until Members of the Council have discussed in details and formed the Council's views. As I have said, the Keep Hong Kong Clean Committee is currently discussing this matter and a conclusion will be reached at soon. As to why it is said that there is little deterrent effect at present, it should be discussed in details at the Public Health Select Committee or Keep Hong Kong Clean Committee. We should obtain data and views from different sides and it is not really appropriate to give a short reply at today's meeting.
To the question of whether the Public Health Select Committee can discuss this matter, of course it can. In fact, the Keep Hong Kong Clean Joint Committee of the two Municipal Councils is discussing this.
As to how to handle the matter when there is conflict between the policies and matters of the Steering Committee and those of this Council, Mr. Chairman, I do not wish such conflict will arise because new policies warranting amendments to legislation must be routed through this Council.
MR. CHAN KWOK-LEUNG (in Cantonese):-Mr. Chairman, activities of the Healthy Living Campaign are not simply to do with health or keep clean. There is a lot more to them. I have three follow-up questions. First of all, has the Steering Committee jumped the gun in piling up things? The Chairman of the Select Committee just mentioned the terms of reference of the Healthy Living Steering Committee and we have learnt that they are restricted to the policy and
