HONG KONG PROVISIONAL URBAN COUNCIL
Ms. Carlye Tsui Wai-ling (in Cantonese):- Mr. Chairman, Section 26 of the Provisional Urban Council, Cap. 101 provides that "the principal executive officer of the Council shall be the Director of Urban Services" while Section 27 states, 'The Council shall discharge its functions through the Urban Services Department which shall, under the direction of the Director of Urban Services, do all acts and things necessary for implementing the decisions of the Council', stipulating clearly the binding effect on the Director of Urban Services in implementing the Council's policies and carrying out his/her duties.
Society is progressing at a rapid pace. The population in the urban areas is very large. Aspirations of the people towards their living quality are rising while unexpected problems in environment and hygiene often prop up. In embodying democracy and accountability, and in coping with the ever-changing demands of the community, the Council must make sure that its policies are being carried out, faithfully and consistently implemented and have achieved the desired effect. At present, the Urban Services Department has not been able to provide full information about its implementation of the related policies. Hence there is a need for the Council to step up supervision over the Department's implementation of its policies. I understand fully the spirit behind the motion and I agree with the first sentence of the motion,
Apart from the arrangement of asking the Director questions and querying her, regular briefings on the implementation of material policies could be appropriately included, so as to reinforce the follow-up mechanism. Of course, when carrying out their duties, Members must listen to public views, understand fully the pulse of society, analyse the implementation of policies and then carry out a comprehensive review. The motion is targeted at strengthening monitoring and finding out how policies are being implemented through raising questions and queries. However, no mention is made of other complementary monitoring arrangements. The motion is therefore not comprehensive enough.
Councillors who are members of the DAB do not agree with the main proposal of the motion, that is, provision of a question-and-answer session for the Director of Urban Services at the monthly meetings of the Council. There are four reasons.
Firstly, Section 26 of the Provisional Urban Council Ordinance, Cap. 101 provides that the Director of Urban Services shall attend the meetings of the standing committee and report on the execution of its decisions. In addition, led by the Director, the staff of the Department shall attend the meetings of the Standing Committee, Select Committees and even the various Sub-Committees to explain policy proposals and report on the execution of the decisions. There is at present also the channel for Members to raise questions under the agenda item of 'Any Other Business', which are replied to by the Department. Accordingly, if the Council wishes to find out whether its policies are being faithfully implemented, appropriate procedures may be introduced into the
