In fact, Housing Managers of estates in Shamshuipo indicated that they would not mind their contractors being prosecuted. In order to improve the hygiene condition and RCP management of housing estates, prosecution must be stepped up.

MR. JOSEPH CHAN YUEK-SUT (in Cantonese): Mr. Chairman, the HD is at present only responsible for providing USD with the basic facility of RCPs. If we put to them standards required by us, they only take them as reference. They are not obliged to follow our standards. So, even if we put to them our standards time and again, the Housing Authority and HD can still decide on their own discretion. One does not follow the other.

The number of housing estates is growing. Many municipal facilities within the control of the HD are not directly managed by this Council, but by the HD. Markets and recreation sites in estates, hawker control are examples of these. The HD is delegated by the USD to manage. Mr. Chairman, we should tackle this inconsistency and improve. The best way is for one single department to be responsible for municipal services of the same nature so that everything is uniform and standardized. Unfortunately, this Council does not have legal powers to do so. I suggest that the Council should be given that statutory power to require the HD to abide by our standards for municipal services.

Another suggestion of mine is for housing estates to adopt standards of this Council at the design stage in the building of RCPs, markets or playgrounds. On completion, some playgrounds at housing estates are handed over to this Council for management. All matters within the terms of this Council's reference should be under the authority of one department.
