If sewage or water for storing fish leaks out from a shop, it can be dealt with summarily under section 127 of the Public Health and Municipal Services Ordinance, Cap. 132, which applies to abatement of nuisance.
For the third part of the question, the sale of vegetables does not require any permission of the Council. However, poultry and live fish are restricted foods specified in the Second Schedule of the Food Business (Urban Council) Bylaws, Cap. 132 and the vendor must obtain a Fresh Provision Shop Licence with specific requirements before he can sell these foods for human consumption.
For the fourth part of the question, there is a clear Council policy on shop front extension. District staff can deal with the situation in two ways. If the shop front business is connected with the licensed fresh provision shop, prosecution action can be taken against the licensee under Bylaw 35C of the Food Business (Urban Council) Bylaws, Cap. 132 for unauthorized extension of food business and section 4A of the Summary Offences Ordinance, Cap. 228 for obstruction of public place. If the business at the shop front is independent from that of the shop, the business outside the shop can be treated as illegal hawking and the Hawker Control Team can take action under section 83B of the Public Health and Municipal Services Ordinance, Cap. 132 and section 4A of the Summary Offences Ordinance, Cap. 228. Joint operations of the hygiene and hawker control staff are conducted to deal with these cases as and when necessary.
MR. CHAN KWOK-LEUNG (in Cantonese): Mr. Chairman, as shown by the statistics, the number of fresh provision shops prosecuted in the past is neither large nor small. In the past year there were some 500 cases, meaning that at least one out of every 3 shops was prosecuted and nearly 2 fresh provision shops were prosecuted every day. The frequency of inspection may affect the number of prosecution. The timing of inspection may also affect the hygienic condition of these fresh provision shops. The most important thing is that there are characteristics in the operation of these fresh provision shops. Generally speaking, the most busy hours are the marketing sessions in the morning and evening, but in the even earlier hours (around 7 a.m.) when the offal and dressed meat are delivered, it is the most chaotic period to the fresh provision shops, with dressed meat everywhere on the floor and offal hung or placed freely. If our law-enforcing staff were around, I am sure the number of prosecution would multiply but regrettably, most of the health inspectors have not yet gone to work. Could the Chairman of the Select Committee tell us when our law-enforcing staff carry out inspections? When do they go to the fresh provision shops in the morning for inspections?
