(4) MR. Wu CHI-WAI asked (in Cantonese):-
(a) At present, food kiosks are set up in the recreational venues managed by the Urban Services Department. In the contracts signed between the Department and the operators of the food kiosks, are there any provisions requiring citizens or organizations not to bring any food or drinks inside the venues, apart from food or drinks purchased from the food kiosks? Has the Department received any complaints from citizens or organizations in this regard?
(b) Does the Council consider that disallowing citizens to bring food or drinks inside the above venues is a fair practice? If yes, what are the reasons? If no, will the Council review the relevant practice to allow citizens to freely bring food or drinks inside the venues? If a review is to be conducted, please briefly describe the review timetable."
MR. RONNIE WONG MAN-CHIU, CHAIRMAN OF THE RECREATION SELECT COMMITTEE, replied (in Cantonese):—Mr. Wu's question is composed of two parts. The first part enquires whether there are any provisions in the contracts signed between the Department and the operators of the food kiosks requiring citizens or organizations not to bring any food or drinks inside the venues, and whether the Department has received any complaints from citizens or organizations in this regard.
In the contracts signed between the Department and the operators of the food kiosks, there are no provisions requiring citizens or organizations not to bring food or drinks other than those provided by the food kiosks inside the venues. Neither has the Department received any complaints from citizens or organizations in this regard. However, when citizens or organizations hire recreational venues with food kiosks, upon confirmation of their application, the hirers will be informed of the following:
'The operator of the refreshment kiosk/restaurant in this venue has the franchise to sell refreshment items. No food and drink may be brought into the ground for sale or resale or free distribution, unless prior written approval has been obtained from the venue manager.'
The second part of the question enquires whether the Department considers that disallowing citizens to bring food or drinks inside the above venues is a fair practice. If yes, what are the reasons? If no, will the Council review the relevant practice? Mr. Wu also requested the Council to briefly describe the review schedule.
The Department considers that citizens should not be forbidden to bring food or drinks other than those provided by the food kiosks inside the venues for their own consumption. However, if citizens or organizations bring food or drinks other than those provided by the food kiosks inside the venues for sale, resale or free distribution, then the franchise of the operators of the food kiosks to sell refreshment items in the venues will be infringed, which is unfair
