(4) MR. LEE KWOK-KEUNG asked the following question (in Cantonese):-In the urban area, there are a number of Siu Mei Shops selling Siu Mei and raw meat at the same time, and it is worrying that handling cooked food and raw meat concurrently may give rise to food hygiene problems. I have the following question:
(a) Under the existing legislation, can shops possessing a Siu Mei and Lo Mei licence sell Siu Mei and raw meat at the same time? If not, are these shops required to apply for other licences, such as a fresh provision shop licence? (b) During the past six months, has the Urban Services Department taken follow up actions in respect of those shops selling both Siu Mei and raw meat? Have the departmental officers taken any prosecution actions? Which legislation has been used in prosecuting the shops concerned? What penalties have been imposed? How many such cases are there? (c) Regarding the selling of raw meat in Siu Mei Shops, will the Department conduct reviews, step up inspections and issue guidelines to Siu Mei Shops in the urban area so as to avoid their committing the offence unintentionally?
Mr. Joseph CHAN YUEK-SUT, Chairman of THE PUBLIC HEALTH SELECT COMMITTEE, replied as follows (in Cantonese):-This three-part question concerns the monitoring of the sale of raw meat together with Siu Mei in licensed Siu Mei and Lo Mei Shops. The first part enquires if a shop possessing a Siu Mei and Lo Mei Shop Licence can sell Siu Mei and raw meat at the same time, and if a Fresh Provision Shop Licence is required.
For the purpose of preventing contamination of ready-to-eat food, the sale of Siu Mei Lo Mei and the sale of raw meat require separate licences, viz a Siu Mei Lo Mei Shop Licence and a Fresh Provision Shop Licence respectively. Under the current licensing policy, Siu Mei Lo Mei and raw meat must be sold in separate premises. In some cases both businesses are carried out in a single shop unit. However, the portion to be licensed as Siu Mei Lo Mei Shop must be segregated by brick wall from the portion to be licensed as Fresh Provision Shop. Separate entrances for customers to these two portions of the premises must be provided.
The second part of the question enquires about follow-up and prosecution actions taken by the Department against such shops in the past six months under the relevant legislation, and the penalties imposed. Both Siu Mei Lo Mei and raw meat are restricted food items specified under Bylaw 31 of the Food Business (Urban Council) Bylaws and the sale of these food items requires permission of the Council in writing. Licensees of Siu Mei Lo Mei Shops must also adhere to the licensing condition which prohibits the licensed premises to be used for other classes of business without permission of the Council.
