MR. WU CHI-WAI asked the following question (in Cantonese):-On the problem of littering, I would like to ask:
(a) In the past 3 years, how many ‘litter bugs' were prosecuted?
(b) What are the procedures for prosecuting these law breakers?
(c) How many staff are responsible for carrying out such prosecution work?
(d) Is there any special arrangement on 'arresting litter bugs' in public gathering areas, such as the Central District on Sundays, and places where large scale Urban Council activities are held?
Mr. Chan Yuek-sut, CHAIRMAN OF THE Public Health Select Committee, replied as follows (in Cantonese):-This question concerns the problem of littering and the enforcement action against littering taken by the Department.
Over the past three years, a total of 93,510 ‘litter bugs' have been successfully prosecuted. There were 26,907 convictions in 1992, 26,602 convictions in 1993, 24,068 convictions in 1994 and 15,933 convictions up to the end of August 1995.
Authorised officers of the Department will take prosecution action whenever they witness litter offences being committed. The action officer will ask the offender to provide his or her personal particulars for purposes of the summons form otherwise known as Form 1A. This Form 1A consists of four copies, one of which will be issued on the spot to the offender who will be informed of the charge or charges as well as the date, time and place of the hearing. Should the offender refuse to co-operate or fail to provide documentary proof of identity, police assistance will be sought.
The Department's prosecution section will retrieve any previous conviction records of the offender from U.S.D.'s computerised record system so that the information can be laid before the concerned magistrate,
Presently, there are some 500 officers in District Cleansing Sections, authorised to take out enforcement action against litter offences. In addition, some 1,000 officers in other sections such as the Environmental Health Section, Hawkers Sections, Market Section and the Recreation, Amenities and Sports Section are also authorised to take parallel enforcement action.
Whenever there are large scale Urban Council activities scheduled to be held in parks or other such venues, the Department will assess the number of likely
