As regards other types of venues and public areas, the Department always consults the Television and Entertainment Licensing Authority and/or the Obscene Articles Tribunal in case of doubt before displaying works of art in such locations.

In the case of art works presented by Council in these venues, selection is based on artistic merits and the works are displayed in the interests of art. According to Section 28 of the Ordinance this should constitute a defence of public good against any possible charge.

In the case of art exhibitions organized by hirers of Council venues, the TELA when issuing the Places of Public Entertainment Permit to such hirers always reminds them to comply with the Control of Obscene and Indecent Articles Ordinance. The venue managers of the Department are also always on the alert and will consult the Authority and/or the Tribunal whenever there are doubts regarding any articles displayed in a hirer's exhibition.

Ms. JENNIFER CHOW (in Cantonese):—Mr. Chairman, as the Council is an organization for the promotion of culture and art and in view of this incident which has given rise to a debate about what is art and indecency, I would like to ask whether the Council will take the initiative to liaise with the Obscene Articles Tribunal to step up communication so that there will be a clearer definition of pornography and art?

MR. MOK YING-FAN (in Cantonese): The Museums Select Committee will give due thought to Ms. Jennifer CHOW's suggestion.

(1) THE HONOURABLE SZETO WAH asked the following question (in Cantonese):— Recently, a child was squeezed in an escalator and hurt in Ngau Tau Kok Market. Can the Chairman of the Markets and Street Traders Select Committee advise the Council:

(a) Whether the Department has made any investigation on this case? If the answer is in the affirmative, what are the findings? If no investigation has been carried out, what are the reasons?

(b) Whether the establishment and strength of managerial staff for the Ngau Tau Kok Market are adequate?

(c) Whether the injured child would get any compensation?

MR. IP Kwok-chung, CHAIRMAN OF THE MARKETS AND STREET TRADERS SELECT COMMITTEE replied as follows (in Cantonese):—This three-part question concerns an accident which took place in Ngau Tau Kok Market on 15 June 1995 in which a child's right foot was trapped in the escalator.

The first part asks whether there has been any investigation of the accident and if affirmative, what are the findings. It has been established that at about 5.50 p.m. on 15 June 1995, a market foreman reported to the Police a case of a child's foot being trapped in Escalator No. 2 of the market. The Police and
