'RESOLVED that the Urban Council (Fees for Official Signatures and Miscellaneous Services) (Repeal) Bylaw 1995 be made under section 41A(7) of the Urban Council Ordinance, Cap. 101.'

He said (in Cantonese):-As Chairman of the Finance Select Committee, Mr. Chairman, I rise on the motion standing in my name.

The Urban Council has made the determination of fees under section 41A(1) of the Urban Council Ordinance (Cap. 101). As a follow-up of this determination, it is necessary to repeal the Urban Council (Fees for Official Signatures and Miscellaneous Services) Bylaws (Cap. 101 page B1) in its entirety for the purpose of tidying up the legislation. This Bylaw repeals the principal By-laws.

Against this background, Sir, I so move.

'RESOLVED that the Hawker (Urban Council) (Amendment) Bylaw 1995 be made under section 83AA(5) of the Public Health and Municipal Services Ordinance, Cap. 132.'

He said (in Cantonese):-Mr. Chairman, I rise to move the motion standing in my name.

The Hawker (Urban Council) (Amendment) Bylaw 1995 repeals the fees for hawker licences and for the allocation of fixed pitches specified in Part I and Part III of the Schedule to the Hawker (Urban Council) Bylaws with effect from 1 April 1995.

The revised fees for the issue and renewal of hawker licences and for the allocation of fixed pitches were determined by the Council on 3 January 1995 under section 83AA(1) of the Public Health and Municipal Services Ordinance, Cap. 132, and published in the gazette in a general notice for public information on 20 January 1995. The revised fees will be effective on 1 April 1995.

The proposed fees revision has already taken into consideration various factors, including:

(a) Administrative cost increases relating to managing licensed hawkers since the last review and the estimated deficit incurred by the Council if the fees are not revised;

(b) The desirability of containing the extent of Council's subsidy as far as practicable;

(c) The affordability of the fee increases and the acceptability to those concerned; and

(d) General price increases since the last revision in April 1994.

The proposed fee increases are moderate. In dollar terms, the revised fees would mean an additional cost of only 40 cents per day for most licensed itinerant hawkers, $1.30 per day for most licensed fixed pitch hawkers and $8.00 per day for licensed cooked food stall operators. The impact of the fee increases on general price levels will be minimal.

Mr. Chairman, the revised hawker licence and pitch fees have been agreed by the Markets and Street Traders Select Committee, the Finance Select Committee and the Standing Committee of the Whole Council.
