## QUESTIONS

1. MR. CHAN TAK-CHOR asked the following question (in Cantonese):—The operation of certain food business has aroused widespread public concern. In the past, under the old regulations, food business licences were automatically renewed every year which resulted in the increase of complaints from the public. In view of this, the Council has introduced a review system for the renewal of food business licences. I would like to know:

(1) How many applications for licence renewal have been reviewed since the introduction of the review system by the Council in March this year?

(2) What is the progress of licence renewal in respect of the pig-roasting factory at Sai Street in Sheung Wan?

DR. RONALD D. B. LEUNG, CHAIRMAN OF THE PUBLIC HEALTH SELECT COMMITTEE, replied as follows (in English):—This question concerns follow-up actions taken by the Department subsequent to introduction of the review system for the renewal of food business licences in March this year. The first part asks the number of licences that have been reviewed, and specifically enquires about the progress of licence renewal in respect of the pig-roasting factory at Sai Street in Sheung Wan.

Since the introduction of the review system for the renewal of food business licences, the Department has started looking at problem premises and setting priorities to deal with individual cases.

Members are aware that the aim of the review system is to ensure licensed food premises with wide public concern relating to health, fire safety, building/structural suitability, environmental pollution and nuisances are, where the expressed public concern is factually based, improved up to the standard required before renewal of the licence concerned. The review is a thorough and hence time-consuming process as it entails checking by all concerned departments which include Buildings and Lands Department (BLD), Fire Services Department (FSD) and of course by USD's own comprehensive consideration to determine whether or not additional requirements and conditions should be imposed on the licence to bring about improvement or whether renewal of the licence should be rejected. If it is determined that additional requirements and/or conditions are necessary, a 90-day notice will be served to the licensee requiring them to rectify the problems before the expiry of the licence.

The pig roasting factory at Sai Street meets the criteria of the review system and was the first and only review case to be dealt with by our Department.

In this case the two principal consulting departments (BLD and FSD) and USD have supported the continued licensing of the food factory subject to certain additional requirements. Based on these recommendations and having regard to the limited time left before its licence is due to expire by end of September, the Council has decided to renew this licence unconditionally upon its expiry on 1 October 1990 and, during the tenure of the 1990-91 licence, a 90-day notice will be served requiring the licensee to comply with additional improvements as recommended by BLD and FSD within a specific period of time. The Department will follow up on the issue of this 90-day notice accordingly and monitor the progress of improvement works.

MR. CHAN TAK-CHOR (in Cantonese):—Mr. Chairman, it is learnt from the reply that the Department or rather the Council has renewed the licence for the pig roasting factory. Since this pig roasting factory has been a subject of complaints for a long time by the residents, I am rather surprised why we have renewed the licence and not until the factory has made the necessary improvements first? Secondly, the views given by the Environmental Protection Department have not been mentioned in the reply. In our review system, it is mentioned that the environmental and hygiene criteria must be met and no nuisances should be caused to the residents before the licence should be renewed. As far as I know, the EPD is not at all happy with the nuisances caused to residents by this pig roasting factory.

Since this factory has been operated for a long time, it would cause undue hardship to the licensee to require him to complete the improvement works within such a short period of time. Therefore the Department recommended the renewal of licence for one year and to give him enough time to complete the improvement works which will include the requirements imposed by the Environmental Protection Department. The actual fact is that a delegated member has also read through this case which was approved by him.
