Before taking the first item on the agenda, I would like to congratulate Dr. Samuel WONG on being awarded the M.B.E. As he is not here, we congratulate in his absence. And also I would like to congratulate Dr. Ronald LEUNG on being appointed as the F.R.C.P.

The minutes of the meeting held on 12 December 1989, were confirmed.

The following paper was laid on the table:

(1) Report to the Urban Council by the Director of Urban Services and Secretary, Urban Council, for the month of December 1989.

## MOTIONS

1. DR. RONALD D. B. LEUNG, CHAIRMAN OF THE PUBLIC HEALTH SELECT COMMITTEE, moved the following motion:-

'RESOLVED that the Food Business (Urban Council) (Amendment) By-laws 1990, the Frozen Confections (Urban Council) (Amendment) By-laws 1990, the Milk (Urban Council) (Amendment) By-laws 1990, the Commercial Bathhouses (Urban Council) (Amendment) By-laws 1990, the Offensive Trades (Urban Council) (Amendment) By-laws 1990, the Funeral Parlour (Urban Council) (Amendment) By-laws 1990, the Undertakers of Burials (Urban Council) (Amendment) By-laws 1990, the Places of Amusement (Urban Council) (Amendment) By-laws 1990, the Swimming Pools (Urban Council) (Amendment) By-laws and the Places of Public Entertainment (Licences) (Specification of Fees) (Urban Council Area) Notice 1990 be made under sections 56, 35, 49, 123, 92B and 42 of the Public Health and Municipal Services Ordinance, Cap. 132 and section 7A(1) of the Places of Public Entertainment Ordinance, Cap. 172.'

He said (in English):--Mr. Chairman, as Chairman of the Public Health Select Committee, I rise to move the motion standing in my name:

The following amending by-laws, namely,

(i) the Food Business (Urban Council) (Amendment) By-laws, 1990; (ii) the Frozen Confections (Urban Council) (Amendment) By-laws, 1990;

(iii) the Milk (Urban Council) (Amendment) By-laws, 1990; (iv) the Commercial Bathhouses (Urban Council) (Amendment) By-laws, 1990;

(v) the Offensive Trades (Urban Council) (Amendment) By-laws, 1990; (vi) the Undertakers of Burials (Urban Council) (Amendment) By-laws, 1990;

(vii) the Funeral Parlour (Urban Council) (Amendment) By-laws, 1990; (viii) the Swimming Pools (Urban Council) (Amendment) By-laws, 1990 made under the Public Health and Municipal Services Ordinance, now before the Council will, when adopted, increase fees for the following licences and permits for the following types of businesses:

(i) restaurants by 13%;

(ii) food factories, milk factories, frozen confections factories, bakeries, factory canteens, cold stores, siu mei and lo mei shops, fresh provision shops, temporary food businesses and sale of restricted food by 30%; (iii) Commercial bathhouses, offensive trades, swimming pools, undertakers of burials, and funeral parlours by 15%.

The Places of Public Entertainment (Licences) (Specification of Fees) (Urban Council Area) Notice 1990 made under the Places of Public Entertainment Ordinance seeks to increase the fees for places of public entertainment licences by 29%. The Places of Amusement (Urban Council) (Amendment) By-laws 1990 made under the Public Health and Municipal Services Ordinance seek to increase the fees for public table tennis saloon and public skating rink licences by 100%.

The existing fees for these licences and permits were last revised in June 1987 and there has been no increase for 1988-89. Under the existing Council's policy, all fees for licences and permits should be designed to cover administrative costs by not more than a reasonable margin. If these fees are not increased, the Public Health Select Committee will incur an accumulated deficit of about $8.6 million for the years 1988-89 and 1989–90 in the licensing and control of these businesses.

The purpose of the amending By-laws and Notice is to help meeting the annual cost of administering the licensing and control system of these businesses and to maintain a reasonable standard of hygiene.

The increases have been carefully considered by the Public Health Select Committee and the Standing Committee of the Whole Council, and I am satisfied that due weight has been given to all implications of the proposals.
