MOTION

1. MR. SHUM Choi-sang, Chairman of the MARKETS AND STREET TRADERS SELECT COMMITTEE, moved the following motion:-

(a) a Declaration be made under section 79 of the Public Health and Urban Services Ordinance, Cap. 132 to amend further the Declaration of Markets in Urban Areas first published in the Gazette as Government Notice Number 1620 of 1960; and

(b) the Public Health and Urban Services Ordinance (Amendment of Tenth Schedule) (No. 1) Order 1985 be made under section 79 of the Public Health and Urban Services Ordinance, Cap. 132.’

He said (in English):---Mr. Chairman, I rise to move the motion standing in my name:

'RESOLVED that:-

(a) a Declaration be made under section 79 of the Public Health and Urban Services Ordinance, Cap. 132 to amend further the Declaration of Markets in Urban Areas first published in the Gazette as Government Notice Number 1620 of 1960; and

(b) the Public Health and Urban Services Ordinance (Amendment of Tenth Schedule) (No. 1) Order 1985 be made under section 79 of the Public Health and Urban Services Ordinance, Cap. 132.'

The purpose of this Declaration is to declare the newly-completed Kwun Tong Ferry Concourse Cooked Food Market as a 'market' under section 79 of the Public Health and Urban Services Ordinance, whereas the Order is aimed to include the said market in the Tenth Schedule to the Ordinance, in compliance with legal requirements.

MR. LEE CHIK-YUET, VICE-Chairman of THE MARKETS AND STREET TRADERS SELECT COMMITTEE, seconded (in English):-Mr. Chairman, I would like to second the motion.

MR. CHAN CHI-Kwan, Peter ADDRESSED THE CHAIRMAN (in English):—Mr. Chairman, may I rise on a point of order. I rise on a point of order under Standing Order 19(1)(i). I raised some years ago but the then Chairman ruled that out of order, but I think it is in order because Standing Order 19(1)(i) says that the business of the Council should have an item called 'Any Other Business' and for all these years, this Council has been flouting Standing Order 19(1)(i), by not including this ‘Any Other Business', which to some chairmen may have some nuisance value, because we can raise anything under 'Any Other Business'. But I think at this stage, everybody is talking democracy and it will be election here and there, I think we should include an item of 'Any Other Business' in the agenda. If, Mr. Chairman, you think this is a lot of nonsense, let us have a discussion on it now and I think it is in order because we discuss the procedure of this Council particularly on this point ‘Any Other Business'.

CHAIRMAN (in English):-May I refer it to the next Standing Committee of the Whole Council.

ADJOURNMENT-3.20 p.m.
