Sir, I beg to move the motion.

MR. ALEX S. C. WU (in English):--Mr. Chairman, I have pleasure in seconding the motion.

MR. B. A. BERNACCHI (in English):-Mr. Chairman, I merely wish to say that the motion has been considered by the Finance Select Committee from the point of view of the slight financial implications.

The question was put.

The motion was carried unanimously.

(3) MR. HENRY H. L. HU, CHAIRMAN OF THE HAWKERS SELECT COMMITTEE, moved the following (in English):

"RESOLVED that the Hawker (Permitted Area) (Amendment) Declaration 1975 be made under By-law 4(1) of the Hawker By-laws."

He said: Mr. Chairman, in rising to the motion in my name, I would like to draw Members' attention to the fact that most of the changes in the times proposed for the Hawker Permitted Areas are of a minor nature and made to take into account the interests of the shopkeepers and residents and as far as possible meet with the normal hawker trading patterns.

The major difference is that in all night hawking areas the permitted hours now cease at 11 p.m. and have been amended to conform with Section 13(1)(a) of the Summary Offences Ordinance, Chapter 228, which prohibits the making of any noise which may disturb or interfere with public tranquillity or annoy any person between the hours of 11 p.m. and 6 a.m.

MR. TSIN SAI-NIN (in Cantonese):-Mr. Chairman, I second the motion.

The motion was carried with 19 for and 1 abstention.
