The Motion was carried with 12 votes for and 5 abstentions.
MR. SALES:-Excuse me, Mr. Chairman, may I ask a question for clarification. You said you abstained because of Standing Order 10(1), that is to say you consider the Motion ultra vires of the Council. Certainly it went through standard approval of Standing Committee of the Whole Council.
CHAIRMAN:-I accept it went through Standing Committee, but I still abstain.
MR. SALES:-You are not abstaining on the contents of the Motion.
CHAIRMAN: It was ultra vires in part and it still remains so as far as I am concerned, in spite of Standing Order 10(1).
MR. SALES:-As to procedure, but not as to content?
CHAIRMAN:-No.
MR. SALES: Thank you, then you would have supported it. (Laughter).
(Mr. B. A. BERNACCHI left at this point).
(2) THE CHAIRMAN, URBAN COUNCIL, moved the following motion:-
"RESOLVED—
(1) Under Section 59 of the Urban Council Ordinance that the persons whose names are set out in the first column of the attached Schedule shall be the members of the Select Committees detailed for the period up to the commencement of the first meeting of the Urban Council in April, 1972, except that Mr. Peter P. K. NG, Mr. James M. H. Wu, Mr. Peter P. F. CHAN, Mrs. C. J. SYMONS and Mr. John MACKENZIE, whose respective terms of office as Appointed Members expire on 31st March, 1972, shall be members of the relevant Select Committees until that date.
(2) Under Standing Order 22(6) that the Chairman of each Select Committee shall be as set out in the first column of the attached Schedule for the period up to the commencement of the first meeting of the Urban Council in April, 1972, except that Mr. Peter P. K. NG and Mrs. C. J. SYMONS, whose respective terms of office as Appointed Members expire on 31st March, 1972, shall be Chairmen of the relevant Select Committees until that date.

(3) Under Section 60(1) of the Urban Council Ordinance and Section 5(1) of the Resettlement Ordinance that the powers and functions of the Council as set out in the second column of the attached Schedule be delegated to the Select Committees shown in the first column for the period up to the commencement of the first meeting of the Urban Council in April, 1972.
(4) Under Section 60(1) of the Urban Council Ordinance that the powers of the Council under Section 59 of the Ordinance to change by appointment or removal the personnel of each Select Committee be delegated to that Select Committee:
Provided that each such change shall be reported to the Council at its next meeting."
He said:-Ladies and gentlemen, I rise to move the motion standing in my name as item 4(2) on the Order Paper regarding the terms of reference, appointment of Chairmen and composition of Select Committees for 1971-72.
Membership on the various Select Committees and the terms of reference have been agreed by the Standing Committee of the Whole Council.
