HONG KONG URBAN COUNCIL
MOTION.
THE CHAIRMAN moved the following motion:-
RESOLVED that for the purposes of Section 142 of the Public Health and Urban Services Ordinance No. 30 of 1960, and in accordance with Section 60 of the Urban Council Ordinance, 1955, the Urban Council does hereby delegate certain powers contained in the Sections of the Public Health and Urban Services Ordinance scheduled hereunder to the Committee and public officers in that same schedule.

Power delegated to Health Inspectors Environmental Hygiene Select Committee and Assistant Superintendent (Cleansing).
He said: The reasons for this motion have been explained in detail in a Memorandum which is already in the hands of Members. There is therefore no need for me to repeat here all the points made in that Memorandum. Briefly, the object of the motion before Council is to delegate powers under Section 22(2)(b) of the Public Health and Urban Services Ordinance, No. 30 of 1960, to Health Inspectors, which was not done in 1960 owing to an over-sight. This will enable them to seize, remove and detain articles causing obstructions to cleansing after notice to remove the articles has been given to the owners. It is also proposed to delegate powers under Section 86(2) and (3) of the same Ordinance to the Environmental Hygiene Select Committee and the Assistant Superintendent (Cleansing) in order to facilitate the disposal of articles of little or no value abandoned by hawkers, which are found in the streets and form an obstruction to cleansing.
THE VICE-CHAIRMAN seconded.
MR. B. A. BERNACCHI :- Mr. Chairman, whilst I will support the motion, I would point out that powers under section 22(2)(b) which you are proposing to delegate to Health Inspectors are considerable and I trust that you, Sir, will keep the work of the Health Inspectors closely in view and review and if there should be any complaints from any members of the public about the exercise of the authority under the said section you will bring it to the attention of the Council.
CHAIRMAN:- Sir, I gladly give you that assurance.
